Default Divorce

I have a house listed that I am going to be turning into a short sales. Wife is only one on mortgage, but husband is on deed. They are in the process of a divorce so I have put him on all of my paperwork just to cover my butt. My question is... when negotiating with lender, should her name be the only one on all paperwork? His name is listed on listing agreement as well.
